Terms of Service
Last updated: October 3, 2026
These Terms of Service are an agreement between Jiva Creative, LLC, a California limited liability company doing business as CrewCall, and you. "CrewCall," "we," "us" and "our" mean Jiva Creative, LLC. CrewCall is a web platform for planning and running live events: schedules and run of show, cues, crew and labor, travel and lodging, content and media, communications, budgeting and reporting. These Terms cover the CrewCall website, web application, public API and related services, which we call the "Services."
If you accept these Terms on behalf of a company or other organization, you confirm that you have authority to bind it, and "you" means that organization. If you do not agree to these Terms, do not use the Services.
You must be at least 18 years old to create an account or use the Services.

1. Definitions
- "Customer" means the person or organization that holds a CrewCall subscription and pays for it.
- "Organization" means a Customer's workspace in CrewCall, including its events, clients, venues and settings.
- "User" means anyone who accesses the Services through an account, including Customers, team members, crew, and client or portfolio viewers invited by a Customer.
- "Customer Data" means everything a Customer or its Users put into the Services: event details, schedules, scripts, files, media, messages, budgets, estimates and information about people.
2. Accounts, Organizations and Users
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at hey@crewcall.team if you believe your account has been compromised. Registration information must be accurate and kept current.
A Customer controls its Organization. The Customer decides who to invite, what role and permissions each User has, which events and features they can see, and when their access ends. A Customer is responsible for the actions of the Users it invites and for making sure they follow these Terms.
If you were invited to CrewCall by a Customer, for example as crew, a speaker contact or a client viewer, your access to that Customer's events is controlled by that Customer, and the information you see or provide there is part of that Customer's Customer Data.
3. Your Data
You own your Customer Data. We do not claim any ownership of it.
You grant us a worldwide, non exclusive, royalty free license to host, store, copy, transmit, display, convert and otherwise process Customer Data only as needed to provide, secure, support and improve the Services, and as required by law. This license ends when the Customer Data is deleted from the Services, except for copies held in routine backups until those backups expire. We do not sell Customer Data, and we do not use it for advertising.
We may use aggregated, de identified information about how the Services are used, such as feature usage counts and performance metrics, to operate and improve the Services. That information does not identify you, your Users or any person in your Customer Data.
Our handling of personal information is described in our Privacy Notice. We use reasonable administrative, technical and physical safeguards to protect Customer Data. No system is perfectly secure, and you are responsible for keeping your own copies of anything you cannot afford to lose, including exports or archives of important events.
4. Information About Other People
Producing an event means handling information about crew, talent, speakers, vendors, clients and guests: contact details, travel itineraries, hotel reservations, pay rates, emergency contacts, dietary needs and allergies. When you put that information into CrewCall, you are responsible for it. You confirm that:
- you have a lawful basis and any notices or consents required to collect it, share it with your team and store it in CrewCall;
- you will collect only what you need for the event and limit access to the people who need it, using the roles and permissions CrewCall provides; and
- you will respond to requests from those people about their information, and we will help where the Services allow.
The Services are not designed for regulated data such as protected health information under HIPAA, payment card numbers, government identification numbers or bank account details. Do not upload that kind of data. Notes about dietary needs or allergies for catering and safety are permitted.
5. Acceptable Use
You may use the Services for your business, including producing events for your own clients. You agree not to:
- break any law or infringe anyone's rights, including privacy, publicity and intellectual property rights;
- upload content that is unlawful, harassing, hateful, sexually exploitative, defamatory or threatening;
- send spam or unsolicited messages through the email or text messaging features;
- upload malware or anything designed to disrupt, damage or gain unauthorized access to the Services or other people's data;
- probe, scan or test the vulnerability of the Services, or bypass any security, permission or plan limit, except through a coordinated disclosure agreed with us in writing;
- scrape the Services or access them by automated means other than the public API;
- resell, sublicense or provide the Services to third parties as a standalone service, other than giving your own clients and crew access to your events;
- copy, reverse engineer or decompile the Services, except where the law allows it despite this restriction; or
- use the Services to build a competing product.
We may remove content or restrict access when we reasonably believe it violates these Terms or the law. Where practical, we will tell you first and give you a chance to fix the problem.
6. Live Event Use
CrewCall is built to be relied on during shows, but it depends on internet connections, devices, browsers and third party infrastructure that neither of us fully controls. You are responsible for show critical backups, such as printed or offline copies of the run of show, cue sheets, scripts and prompter text, and contact lists for your crew.
The Services are not a life safety system. Do not rely on them for emergency communication, crowd management, rigging or pyrotechnic control, or any use where a failure could cause injury or death.
7. AI Features
Some features use artificial intelligence, including the AI assistant, event summaries and reviews, playlist suggestions and generated voice announcements. When you use them, the relevant Customer Data is sent to our AI providers to produce a result. We do not use Customer Data to train AI models, and we use AI providers under commercial terms that do not permit them to train their models on it.
AI output can be incomplete, inaccurate or inappropriate. Review it before you rely on it or share it, especially schedules, budgets, estimates and anything read aloud to an audience. You are responsible for how you use AI output.
8. Integrations and Third Party Services
You can connect CrewCall to services run by other companies, such as Google, Microsoft, Dropbox, Box, Asana, Slack, Jira, Spotify, Apple Music and calendar apps. When you connect one, you authorize us to exchange data with it on your behalf. Those services are governed by their own terms and privacy policies, and we are not responsible for them, for their availability, or for what they do with data you send them. You can disconnect an integration at any time.
9. Music and Media Rights
Music Manager, Media Tracker and the content features help you organize music, video and other media for your events. They do not grant any license to that media. You are responsible for securing every right you need, including public performance licenses from organizations such as ASCAP, BMI, SESAC and GMR, sync licenses, and releases from people who appear in your media.
10. Text Messages
CrewCall can send text messages for event and account notifications, such as call times, schedule changes and reminders. CrewCall texts only people who have turned on text messages in their own notification settings and confirmed their mobile number with a code we send to it. Each person chooses which notifications reach them by text. Changing your mobile number turns texts off until you confirm the new number.
If you receive CrewCall texts: message frequency varies; message and data rates may apply; reply STOP to opt out at any time, or HELP for help. You can also contact us at hey@crewcall.team. Carriers are not liable for delayed or undelivered messages. A mobile phone is not required to use CrewCall. See our Privacy Notice for how we handle mobile numbers.
11. Public API
If your plan includes API access, you may use the CrewCall API to integrate your own tools with your Organization. Keep your API tokens secret, because anyone holding one can act with its permissions. You must stay within the rate limits and scopes we set, and we may suspend a token that is being misused or that threatens the stability of the Services. These Terms apply to all API use.
12. Plans, Billing and Cancellation
Plans, prices, included features and limits, such as the number of events, are shown when you subscribe or in your billing settings. Some features and additional events cost extra and are billed as described at the time you add them.
Subscriptions are billed in advance, in US dollars, through our payment processor, Stripe, and renew automatically each billing period until canceled. By subscribing, you authorize us to charge your payment method for each renewal and for any add ons you purchase. Prices do not include taxes, which we will add where required.
Where a plan includes a free trial, we will not charge you during the trial. At the end of the trial, your access to paid features is suspended until you choose a paid plan.
You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Payments are non refundable except where the law requires otherwise.
We may change prices. We will give you at least 30 days' notice before a price increase applies to your subscription, and it will take effect at your next renewal after that notice. If a payment fails, we may suspend paid features until it is resolved.
13. Our Intellectual Property
We own the Services, including the software, design, documentation, Help Center content, and the CrewCall name and logo. Subject to these Terms, we grant you a limited, non exclusive, non transferable right to use the Services for your business during your subscription. We reserve all rights not expressly granted.
14. Feedback
If you send us ideas, suggestions or feedback about the Services, we may use them without restriction or obligation to you. This does not give us any rights in your Customer Data.
15. Confidentiality
Events often involve information that is not public, such as unannounced talent, client names, budgets and creative plans. We treat Customer Data as confidential. We access it only to provide and support the Services, to keep them secure, or when you ask us to, and our staff and service providers who access it are bound by confidentiality obligations. We will disclose Customer Data only as described in our Privacy Notice or when required by law. Where the law allows, we will notify you before responding to a legal demand for your Customer Data.
In turn, you agree not to disclose non public information about the Services that we share with you, such as unreleased features or security details, except as needed to use the Services.
16. Copyright Complaints
If you believe content in the Services infringes your copyright, email hey@crewcall.team with: your contact information; a description of the work; where the material appears; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We may share your notice with the Customer responsible for the content.
17. Suspension and Termination
You may stop using the Services and cancel your subscription at any time. Individual Users can delete their own account from their profile page.
We may suspend or terminate your access if you materially breach these Terms, if payment is overdue, or if your use creates a security, legal or stability risk for us or other customers. Unless the situation is urgent or the law prevents it, we will give you notice and a reasonable chance to fix the problem first.
When a subscription ends, we will keep the Organization's Customer Data available for export for 30 days, including through the event archive feature. After that, we may delete it. Sections that by their nature should survive termination will survive, including those on fees owed, intellectual property, confidentiality, disclaimers, limitation of liability, indemnification and disputes.
18. Changes to the Services and These Terms
We continually improve CrewCall, and features may be added, changed or retired. If we remove a feature that is a material part of your paid plan, we will give you reasonable advance notice.
We may update these Terms. If a change is material, we will notify you by email or in the app at least 30 days before it takes effect. Continuing to use the Services after a change takes effect means you accept it. If you do not agree, you may cancel before the change takes effect.
19. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE, THAT AI OUTPUT WILL BE ACCURATE, OR THAT THIRD PARTY DATA SUCH AS FLIGHT STATUS OR WEATHER WILL BE CORRECT OR CURRENT.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR THE COST OF A CANCELED OR DISRUPTED EVENT, EVEN IF ADVISED THAT THEY WERE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 IF YOU HAVE NOT PAID US ANYTHING.
THESE LIMITS DO NOT APPLY TO YOUR PAYMENT OBLIGATIONS, TO A PARTY'S INDEMNIFICATION OBLIGATIONS, OR TO LIABILITY THAT CANNOT BE LIMITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
21. Indemnification
You will defend and indemnify us, and our officers, employees and agents, against third party claims, and the resulting losses, damages and reasonable attorneys' fees, arising from your Customer Data, including claims that you lacked the right to upload information about a person or media you used; your messages to crew and contacts; or your violation of these Terms or the law.
We will defend and indemnify you against third party claims alleging that the Services, as we provide them, infringe that party's United States intellectual property rights, and pay the resulting damages and reasonable attorneys' fees. This does not cover claims caused by Customer Data, by third party services, or by combining the Services with anything we did not provide.
The party seeking indemnity must promptly notify the other party of the claim, allow it to control the defense, and cooperate reasonably.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules.
Talk to us first. Before starting any formal proceeding, the party with a dispute will send written notice to the other, and both parties will try in good faith to resolve it informally for at least 30 days.
Arbitration. If the dispute is not resolved informally, it will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator. The arbitration will take place in Alameda County, California, or remotely if both parties agree. Judgment on the award may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small claims court, and either party may seek an injunction in court to protect its intellectual property or confidential information.
No class actions. Disputes will be resolved only on an individual basis. Neither party may bring a claim as a plaintiff or class member in a class, consolidated or representative proceeding.
Courts. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Alameda County, California.
23. Electronic Communications and Signatures
You agree that we may provide notices, agreements and other communications to you electronically, by email or in the Services, and that they satisfy any requirement that they be in writing. Electronic signatures and acceptances made through the Services, including on estimates sent to your clients, are binding to the extent the law allows.
24. California Users
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
25. General Terms
These Terms, together with our Privacy Notice and any order form or plan terms you accept, are the entire agreement between you and us about the Services. If a signed agreement between you and us conflicts with these Terms, the signed agreement controls. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of all or substantially all of our assets, and we will notify you if we do. Neither party is liable for delays caused by events beyond its reasonable control. These Terms do not create a partnership, employment or agency relationship.
